Every scoop of ice cream or frozen dessert you pick up from a store has to meet strict quality and safety benchmarks before it reaches your hands. In India, two key regulatory frameworks – the Prevention of Food Adulteration Act (PFA) and the Bureau of Indian Standards (BIS) – lay down the rules that govern everything from the fat content in your ice cream to the microorganisms that should never be present in it. These standards exist to protect consumers from adulteration and to ensure that every frozen treat is safe, nutritious, and true to its label. Let’s break down what these regulations actually require.

The Prevention of Food Adulteration Act (PFA) and its role

The Prevention of Food Adulteration Act was enacted in 1954 as India’s first comprehensive law to combat food adulteration. Its primary goal was to ensure that food products sold across the country are safe, wholesome, and free from harmful substances. For ice cream and frozen desserts, the PFA established clear definitions and compositional standards that manufacturers must follow.

Under the PFA and its subsequent amendments, ice cream is defined as a frozen product obtained from cow or buffalo milk (or a combination), cream, and other milk products. It may include additions like cane sugar, dextrose, liquid glucose, maltodextrin, eggs, fruits, fruit juices, preserved fruits, nuts, chocolate, edible flavours, and permitted food colours. The mix must be suitably heated (pasteurised) before freezing to eliminate harmful pathogens.

It is worth noting that the PFA was later superseded by the Food Safety and Standards Act (FSSA) of 2006, and the Food Safety and Standards Authority of India (FSSAI) now enforces these regulations through the FSS (Food Products Standards and Food Additives) Regulations, 2011. However, the compositional benchmarks originally set under the PFA continue to form the backbone of current ice cream standards.

Key compositional standards for ice cream under PFA

The PFA laid down specific minimum requirements for the composition of ice cream. These standards ensure that the product you consume has the right nutritional value, texture, and consistency. Here are the core parameters:

Milk fat content

Ice cream must contain a minimum of 10% milk fat. This is the component responsible for the rich, creamy mouthfeel that consumers expect. Milk fat also serves as a natural carrier for flavour compounds, making the ice cream taste better. For fruit or nut ice cream, the minimum fat requirement is slightly lower at 8%, since the fruit or nut portion displaces some of the base mix.

Protein content

The minimum protein content is 3.5%, derived from milk or milk products. Protein contributes to the nutritional value of ice cream and also plays a functional role – it helps stabilise the emulsion and contributes to the body and texture of the finished product.

Total solids

Ice cream must have not less than 36% total solids. Total solids include all the non-water components – milk fat, milk proteins, sugars, stabilisers, and emulsifiers combined. This requirement ensures the product has proper consistency and doesn’t feel watery or thin.

Stabilisers and emulsifiers

The PFA permits the use of stabilisers and emulsifiers in ice cream, but only up to 0.5% by weight of the product. Commonly used stabilisers include sodium alginate, carboxymethyl cellulose (CMC), guar gum, locust bean gum, carrageenan, gelatin, and pectin. These ingredients help maintain a smooth texture, prevent ice crystal formation, and improve shelf life. Using excessive amounts can lead to a soggy, heavy body with unnatural resistance to melting.

Starch addition

Starch may be added to ice cream to a maximum extent of 5%, but this must be clearly declared on the label. This transparency requirement ensures that consumers know exactly what they are getting.

Categories of ice cream under FSSAI regulations

The FSSAI classifies ice cream under “Dairy Based Desserts/Confections” and recognises several sub-categories. These include ice cream, kulfi, chocolate ice cream, and softy ice cream. All of these are obtained by freezing a pasteurised mix prepared from milk or milk-derived products.

Based on fat content, ice cream is further classified into three types, each with its own compositional requirements:

Regular ice cream

This is the standard category. As per FSSAI regulations, regular ice cream must contain not less than 36% total solids, a minimum of 10% milk fat, not less than 3.5% milk protein, and a minimum weight per volume of 525 grams per litre.

Medium fat ice cream

Medium fat ice cream must have at least 30% total solids, milk fat content between 2.5% and 10%, a minimum of 3.5% milk protein, and a weight per volume of not less than 475 grams per litre.

Low fat ice cream

Low fat ice cream requires a minimum of 26% total solids, milk fat content of not more than 2.5%, at least 3.0% milk protein, and a minimum weight per volume of 475 grams per litre. If the type of ice cream is not clearly indicated on the label, the standards for regular ice cream apply by default.

Ice cream vs. frozen desserts: an important distinction

One of the most significant regulatory distinctions in Indian food law is the difference between ice cream and frozen desserts. Many consumers use these terms interchangeably, but legally, they are entirely different products.

Ice cream must use only milk fat as its source of fat. The fat must come from dairy ingredients like milk, cream, or butter. No vegetable fat or oil is permitted in products labelled as ice cream.

Frozen desserts, on the other hand, are products where milk fat is partially or fully replaced by edible vegetable oils or fats (such as palm oil or hydrogenated vegetable fat) with a melting point not exceeding 37Β°C. The compositional standards for total solids, fat percentages, and protein in frozen desserts mirror those of ice cream categories, but the protein conversion factor differs – it is Nx6.25 for frozen desserts compared to Nx6.38 for ice cream, reflecting the possible use of vegetable protein alongside or instead of milk protein.

This distinction matters because the fat source fundamentally changes the product’s nutritional profile, taste, and texture. Milk fat provides natural dairy nutrients such as calcium, vitamins A and D, and protein, whereas vegetable fats may contain higher levels of saturated or trans fats depending on the oil used. FSSAI mandates strict labelling – products must be clearly identified as either “Ice Cream” or “Frozen Dessert” so that consumers are not misled.

Bureau of Indian Standards (BIS) specifications

The Bureau of Indian Standards complements the PFA/FSSAI framework by providing detailed technical specifications for ice cream. The key standard is IS 2802, originally published in 1964 and revised most recently in 2022 as “Ice Cream and Kulfi – Specification.” This standard prescribes requirements and testing methods for ice cream and kulfi, with or without non-dairy ingredients.

Fat and total solids requirements

The BIS specifies a minimum fat content of 10% and a minimum total solids content of 36% for ice cream, aligning with the PFA requirements. These parameters ensure that BIS-certified products meet the same baseline quality that the law demands.

Microbial limits

One of the most critical contributions of BIS standards is the specification of microbiological safety limits. Since ice cream is a dairy product that passes through multiple handling stages, microbial contamination is a real concern. The BIS standards set the following limits:

Total plate count: The maximum permissible limit is 2,50,000 colony-forming units (CFU) per gram of ice cream. This measures the overall microbial load and indicates the general hygiene level during manufacturing.

Coliform count: The maximum limit is 90 CFU per gram. Coliforms are indicator organisms – their presence suggests potential contamination from faecal matter or unsanitary processing conditions.

Yeast and mould count: The upper limit is 100 CFU per gram. Elevated yeast and mould counts can indicate poor storage conditions or contamination during packaging.

Additionally, ice cream must be tested to confirm the absence of dangerous pathogens like Salmonella, Staphylococcus aureus, and Listeria monocytogenes. These organisms are commonly associated with dairy products and can cause serious foodborne illness if present.

Sensory evaluation

BIS has also published IS 15349 (2003), which provides a standardised method for sensory evaluation of ice cream. This standard covers the assessment of appearance, colour, body, texture, and flavour – ensuring that quality extends beyond just chemical and microbiological parameters to include the actual eating experience.

The regulatory framework doesn’t stop at ice cream and frozen desserts. Several related frozen dairy products have their own compositional standards.

Dried ice cream mix

Dried ice cream mix is the product obtained by spray or roller drying of an ice cream mix. It must contain not less than 27% milk fat, 9.5% protein, and no more than 4% moisture by weight. Stabilisers and emulsifiers are permitted up to 1.25% by weight, and sucrose content should not exceed 40%. The drying process must be mentioned on the label, and the product must be packed in hermetically sealed containers.

Milk ices and milk lollies

These are frozen products made from milk, skimmed milk, or milk products with optional additions of sugar, fruits, nuts, chocolate, and permitted flavours and colours. They must not contain more than 2.0% milk fat, should have at least 3.5% protein, and a minimum of 20% total solids.

Kulfi

Kulfi, India’s traditional frozen dairy dessert, is covered under the same regulatory framework. BIS has a separate standard (IS 10501) specifically for kulfi, addressing its unique manufacturing process where concentrated milk is frozen in moulds without the incorporation of air.

Labelling and compliance requirements

Proper labelling is a cornerstone of ice cream regulation. Under FSSAI’s packaging and labelling regulations, every ice cream product must clearly display the following on its label: the product name (ice cream, medium fat ice cream, or low fat ice cream), a complete list of ingredients, fat source and percentage, nutritional information, allergen declarations, manufacturing and expiry dates, FSSAI licence number, and the manufacturer’s name and address.

If the product contains starch, this must be specifically declared. If it is a frozen dessert rather than ice cream, it must be labelled accordingly – calling a frozen dessert “ice cream” is a violation of FSSAI regulations and can attract penalties. FSSAI also requires that ice cream dealers display their identity and the manufacturer’s details on any stall, vehicle, or container used for selling ice cream.

Since 2025, FSSAI has also mandated allergen declarations in bold on packaging for common allergens like nuts, milk, and gluten – an important step for consumer safety.

Why these standards matter

These standards serve multiple purposes beyond just regulatory compliance. For manufacturers, they provide a clear framework that ensures consistent product quality, reduces the risk of legal penalties, and builds consumer trust. A product bearing the FSSAI logo signals to consumers that it has met defined safety benchmarks – and surveys suggest that a large majority of Indian consumers actively look for this logo before purchasing packaged food.

For consumers, these standards are a guarantee of safety and value. When you buy a product labelled “ice cream,” you know it contains real dairy fat – not a cheaper vegetable oil substitute. When microbial limits are enforced, you’re protected from foodborne pathogens. When labelling rules are followed, you can make informed choices based on actual ingredients and nutritional content.

As the Indian ice cream market continues to grow – with new trends like plant-based alternatives, sugar-free options, and artisanal varieties – these standards will need to evolve. Future regulations may address the safety and quality of novel ingredients, impose stricter nutritional guidelines, and establish more detailed requirements for emerging product categories.
