Not every frozen treat you pick up from the store is technically “ice cream.” Depending on the ingredients, fat content, and preparation method, the same-looking product might be classified as a frozen custard, sherbet, frozen yogurt, or simply a frozen dessert. These classifications aren’t just marketing labels – they’re backed by food safety regulations that protect consumers and maintain product quality. Let’s break down how ice cream and frozen desserts are classified commercially, by flavor, and under regulatory standards.

Why classification matters in the frozen dessert industry

Classification of ice cream and frozen desserts serves a very practical purpose. For manufacturers, it determines how a product can be labeled and marketed. For consumers, it provides clarity on what they’re actually eating. And for regulators, it ensures that minimum quality and safety benchmarks are met across the board.

Without clear classification, a product made with cheap vegetable fats could be sold as premium ice cream, misleading buyers about its nutritional value and ingredients. That’s exactly why agencies like the U.S. FDA and India’s FSSAI have detailed standards defining what qualifies as ice cream, frozen custard, sherbet, and other frozen categories.

Commercial classification of ice cream

In the commercial world, ice cream products are grouped based on their composition, flavoring, and target market segment. These categories help retailers organize their frozen sections and help consumers find exactly what they’re looking for.

Plain ice cream

Plain ice cream is the most basic form, made from milk or cream, sugar, and stabilizers. The flavoring is typically limited to vanilla extract. It serves as the baseline product against which all other types are measured. Despite the name “plain,” it remains the most widely consumed type of ice cream globally.

Chocolate ice cream

Chocolate ice cream gets its own classification because the addition of cocoa powder or chocolate liquor affects more than just the flavour. Cocoa solids are treated as bulky flavoring ingredients under regulatory standards. As per the USDA ice cream standards, when bulky ingredients like chocolate are used, the weight of cocoa solids may be multiplied by 2.5 to calculate allowable reductions in milkfat and total milk solids. This means chocolate ice cream can legally contain slightly less milkfat than plain varieties while still meeting standards.

Fruit ice cream

Fruit ice cream incorporates natural or processed fruits – such as strawberry, mango, or blueberry – into the base mix. Fruits are also considered bulky flavoring ingredients, and regulators allow adjustments to fat and solids requirements to account for their weight. Under FDA rules, the weight of fruit used may be multiplied by 1.4 when calculating compositional standards.

Nut ice cream

When nuts like almonds, pistachios, or cashews are added as primary flavoring, the product falls under nut ice cream. Like fruit and chocolate, nuts add weight to the final product and are accounted for in the minimum fat calculations. Nut-based ice creams tend to have a richer mouthfeel due to the natural fats present in the nuts themselves.

Classification based on fat content and quality segment

Beyond flavour, ice cream is also classified by its fat content and the amount of air incorporated during freezing – a factor known as overrun. These differences directly affect texture, density, and price.

Economy ice cream

Economy ice cream meets the bare minimum regulatory requirements. It typically contains around 10% milkfat and has high overrun (more air), resulting in a lighter, less dense product. It’s the most affordable option on the shelf.

Regular ice cream

Regular ice cream also hovers around 10-11% butterfat but uses slightly better ingredients than economy brands. The International Dairy Foods Association (IDFA) notes that overrun for regular ice cream is typically in the range of 90-100%.

Premium ice cream

Premium ice cream contains 11-15% butterfat and has lower overrun, making it denser and creamier. Manufacturers use higher quality ingredients, and the product tends to carry a higher price point. The richer fat content contributes to a more lingering flavour on the palate.

Super-premium ice cream

Super-premium brands push butterfat content to 14-18% with very low overrun – often less than 50%. This results in the densest, richest product in the ice cream category. Brands in this segment are typically positioned as indulgent, small-batch offerings.

Classification of other frozen desserts

Ice cream is just one member of the larger frozen dessert family. Several other products exist alongside it, each defined by specific compositional differences.

Frozen custard

Frozen custard is essentially ice cream with a higher egg yolk content. According to 21 CFR 135.110, frozen custard must contain at least 1.4% egg yolk solids by weight. If a regular ice cream product happens to exceed this egg yolk threshold, it must be relabeled as frozen custard. The egg yolks give it a smoother, denser texture and a slightly richer taste compared to standard ice cream.

Frozen yogurt

Frozen yogurt, often called “froyo,” replaces cream with cultured milk or yogurt as its dairy base. It contains live bacterial cultures – the same kind used in regular yogurt – and generally has less fat than ice cream. Frozen yogurt became commercially popular in the 1970s and continues to hold a significant market share, especially among health-conscious consumers.

Sherbet

Sherbet sits between ice cream and sorbet in terms of dairy content. It contains just 1-2% milkfat, making it much lighter than ice cream but creamier than a pure fruit-based sorbet. Sherbet is characteristically sweet and fruity, commonly found in orange, raspberry, and lime flavours.

Gelato

Gelato, the Italian counterpart of ice cream, has a lower fat content (typically 4-8%) and significantly less air incorporated during freezing – around 25% overrun compared to ice cream’s 30-100%. This makes gelato denser and gives it a more intense flavour. Traditional gelato also skips egg yolks and relies on milk rather than cream as its primary dairy ingredient.

Sorbet

Sorbet is entirely dairy-free, made from water, sugar, and fruit juice or purΓ©e. It’s the go-to option for those who are lactose intolerant or following a vegan diet. Since it contains no milk or cream, sorbet falls outside the “ice cream” classification entirely.

Kulfi

Kulfi is a traditional Indian frozen dessert made by slowly simmering milk until it thickens, then adding sugar and flavourings like cardamom, saffron, or pistachios before freezing in moulds. Unlike ice cream, kulfi is not churned and does not incorporate air, resulting in a notably denser and creamier product.

Governments worldwide set compositional standards that frozen dessert products must meet before they can use specific names on their labels. These regulations prevent consumer deception and ensure baseline quality.

FDA standards (United States)

In the United States, the FDA’s Code of Federal Regulations (Title 21, Part 135) lays out precise requirements. To be legally called “ice cream,” a product must contain a minimum of 10% milkfat and at least 20% total milk solids. It must also weigh no less than 4.5 pounds per gallon, which effectively limits how much air can be whipped into the mix. Products that fail to meet these criteria must be labeled as “frozen dairy dessert” instead.

The FDA also defines reduced-fat, light, and low-fat variants. For example, reduced-fat ice cream must contain at least 25% less total fat than the standard product, while light ice cream must have 50% less fat and 33% fewer calories than the reference product.

FSSAI standards (India)

In India, FSSAI categorises ice cream under “Dairy Based Desserts/Confections” with specific sub-types including ice cream, kulfi, chocolate ice cream, and softy ice cream. Indian standards require ice cream to contain a minimum of 10% milk fat, 3.5% protein, and 36% total solids.

A critical distinction in India is between ice cream and frozen dessert. As per FSSAI regulations, ice cream must be made exclusively from milk fat, while frozen desserts may use vegetable oils and fats (such as palm oil) as the primary fat source. FSSAI mandates that products using vegetable fats be clearly labeled as “Frozen Dessert” or “Frozen Confection” – not “ice cream.” This labeling rule helps consumers distinguish between dairy-based and plant-fat-based products at the point of purchase.

FSSAI further classifies ice cream into standard ice cream, medium-fat ice cream, and low-fat ice cream based on the percentage of total solids, milk fat, and milk protein used. If the type is not clearly indicated on the label, the full standard for regular ice cream applies by default.

Classification based on serving style and form

Ice cream and frozen desserts can also be classified by how they are served or the physical form they take. This classification is especially relevant in the foodservice and retail industries.

Hard ice cream

This is the traditional scoopable form, stored at temperatures around -18Β°C to -23Β°C. It has a firm texture and holds its shape well in cones and cups. Hard ice cream typically contains 10-16% butterfat and moderate overrun.

Soft serve

Soft serve is dispensed directly from a machine at a warmer temperature than hard ice cream. It contains less milkfat – typically 3-6% – and has higher air content, giving it a lighter, smoother consistency. Soft serve is a staple at fast-food outlets, amusement parks, and roadside stalls.

Sticks and bars

These are factory-produced ice cream products frozen onto sticks. They may be coated with chocolate, nuts, or fruit-flavoured glazes and are designed for individual, on-the-go consumption.

Ice cream cakes and sundaes

Ice cream cakes incorporate layers of ice cream with sponge, cookies, or sauces. Sundaes are assembled from scoops of ice cream topped with syrups, whipped cream, nuts, and other garnishes. Both represent composite frozen dessert products.

Flavor labeling standards

Regulatory bodies also set standards for how flavours can be described on ice cream packaging. In the U.S., the IDFA outlines labeling norms that manufacturers must follow. If a product is labeled with a specific flavour name – say, “Strawberry Ice Cream” – the flavouring must come predominantly from actual strawberries. If artificial or synthetic flavourings are used, the label must reflect that, often with phrases like “strawberry flavoured” or “artificially flavoured.”

Similarly, if a product features a combination of natural and artificial flavours, the label needs to convey this accurately. These rules exist to ensure that consumers aren’t misled about the source of the flavouring in their frozen treat.

Summing up the classification framework

Ice cream and frozen dessert classification operates on multiple levels. Commercial classification groups products by flavour type – plain, chocolate, fruit, and nut. Quality-based classification differentiates economy from premium based on fat content and overrun. Product-type classification distinguishes ice cream from frozen custard, gelato, sherbet, sorbet, frozen yogurt, and kulfi based on ingredients and preparation. And regulatory classification enforces minimum standards for composition and labeling, varying by country.

Together, these classification systems ensure that the frozen dessert market remains transparent, consistent, and consumer-friendly – whether you’re buying a kulfi from a street vendor or a pint of super-premium ice cream from a gourmet store.
