Cream is one of the most widely consumed dairy products in India, used in everything from sweets and desserts to everyday cooking. But have you ever wondered what legal standards govern the cream you buy from the market? In India, the Prevention of Food Adulteration (PFA) Act, 1954 was one of the earliest and most important pieces of legislation that laid down strict quality and safety standards for cream and other dairy products. These standards defined what cream should contain, how it should be classified, and what practices were prohibited – all to protect consumers from substandard and adulterated products.

What is the Prevention of Food Adulteration Act, 1954?

The Prevention of Food Adulteration Act (PFA) was enacted by the Indian Parliament in 1954 and came into effect on June 1, 1955. It was India’s first comprehensive central legislation aimed at tackling the widespread problem of food adulteration. Before this Act, different states had their own laws with varying standards, which created confusion and inconsistency across the country.

The PFA Act was designed with clear objectives: to protect the public from harmful and poisonous foods, to prevent the sale of substandard products, and to eliminate fraudulent practices in the food trade. The Act gave the Central Government the power to set up a Central Committee for Food Standards and establish Central Food Laboratories for testing and analysing food samples. It also defined what constitutes adulteration and laid down penalties for offenders.

This Act became the backbone of food safety regulation in India for over five decades. It was eventually replaced by the Food Safety and Standards Act (FSSA) of 2006, which consolidated multiple food laws under one umbrella through the Food Safety and Standards Authority of India (FSSAI). However, the PFA Act’s standards – especially those for dairy products – remain foundational to understanding India’s food safety framework.

How does the PFA Act define cream?

Under the PFA Act and its associated rules (the Prevention of Food Adulteration Rules, 1955), cream is defined as the fat-rich product obtained from cow or buffalo milk, or a combination of both. This definition is important because it restricts cream production to specific animal sources that are most common in Indian dairying – cows and buffaloes.

The Act makes it very clear that cream must be derived exclusively from milk. It must not contain any foreign or extraneous ingredients such as vegetable oils, artificial fats, starch, sugar, or any other non-dairy substance. This strict requirement was put in place to prevent manufacturers from substituting cheaper non-dairy ingredients to increase volume or reduce costs – a common form of adulteration in the Indian market.

In practical terms, cream as defined by the PFA Act is the fatty layer of milk that either rises naturally to the surface when milk is left undisturbed or is separated using centrifugal (mechanical) separation. The fat content in cream can range widely depending on its intended use, and this is where the classification system becomes critical.

Why is source restriction important?

Limiting cream production to cow and buffalo milk serves two purposes. First, these are the predominant milk-producing animals in India, so the standard reflects the ground reality of Indian dairy farming. Second, it prevents the use of milk from non-standard sources or the mixing of non-dairy fats (such as palm oil or vanaspati) into cream products – a practice that not only compromises quality but can also pose health risks.

Classification of cream under the PFA Act

One of the most practical contributions of the PFA Act to dairy regulation is its classification of cream into three distinct categories based on minimum milk fat content. This classification ensures that consumers know exactly what type of cream they are purchasing and that manufacturers adhere to defined compositional standards.

Low fat cream

Low fat cream, as defined under the PFA Act, must contain a minimum of 25% milk fat. This is the lightest category of cream and is commonly used as a pouring cream for coffee, tea, soups, and light desserts. Its relatively lower fat content means it has a thinner consistency compared to other cream types.

Under the original PFA standards, the requirement that cream should contain not less than 25.0% milk fat was the baseline standard for cream sold in the market (excluding sterilised cream). This 25% threshold served as the entry point for any product to be legally called “cream.”

Low fat cream is suitable for everyday culinary uses where richness is needed without excessive heaviness. It blends well into beverages and can be used in light sauces. However, it is generally not suitable for whipping because the fat content is too low to create a stable foam.

Medium fat cream

Medium fat cream must contain a minimum of 40% milk fat. This category falls in the middle of the fat content spectrum and offers a richer texture and flavour compared to low fat cream. Medium fat cream is versatile – it can be used for cooking, baking, and even light whipping applications.

The 40% fat threshold makes medium fat cream well-suited for making rich sauces, custards, and Indian sweets that require a substantial cream base. It provides enough fat to contribute body and mouthfeel to dishes without being as dense as high fat cream. For the food processing industry, medium fat cream serves as a practical middle-ground ingredient for products that need richness but not the full heaviness of high fat cream.

High fat cream

High fat cream is the richest category, requiring a minimum of 60% milk fat. This is a very concentrated dairy product and is primarily used for specialised applications in both domestic cooking and commercial food manufacturing.

High fat cream is the preferred raw material for making butter, as the high concentration of milk fat allows efficient churning. It is also used in the production of ghee and butter oil. In the confectionery and bakery industry, high fat cream is valued for producing rich, dense textures in products like ganache, truffles, and premium ice creams.

Due to its extremely high fat content, this type of cream is calorie-dense and is typically not used as a direct table product. Instead, it functions as an industrial or manufacturing-grade ingredient that gets processed further into other dairy products.

How these standards compare with current FSSAI regulations

While the PFA Act of 1954 laid the groundwork, India’s dairy standards have evolved considerably since then. The FSSAI regulations under the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 now govern cream standards. Under the current FSSAI framework, cream must contain a minimum of 10% milk fat overall, and the classification has been updated:

Low fat cream is now defined as having a minimum of 10% and less than 40% milk fat. Medium fat cream ranges from a minimum of 40% to less than 60% milk fat. High fat cream requires a minimum of 60% milk fat. The FSSAI standards also specify that the acidity of finished cream products (other than fermented and acidified creams) should not exceed 0.15% expressed as lactic acid.

The key difference is that the FSSAI broadened the low fat category to start at 10% instead of the PFA’s 25%, reflecting international practices such as those outlined by the Codex Alimentarius, which also sets 10% as the minimum fat content for cream. This change allows for a wider range of lighter cream products in the market while still maintaining quality control.

Additionally, FSSAI regulations now require that the type of cream and its fat content must always be indicated on the label, whether the product is pre-packaged or sold loose from a container. Products made through recombination or reconstitution of dairy ingredients must also be clearly labelled as such.

Legal standards for cream are not just bureaucratic requirements – they serve several critical functions in protecting both consumers and the dairy industry.

Consumer protection

Without defined fat content thresholds, there would be no way to verify whether a product labelled as “cream” is actually cream or a diluted, adulterated mixture. The PFA Act’s standards gave food inspectors and public analysts clear benchmarks to test products against. If a product labelled as cream contained less than 25% fat (under PFA standards), it could be deemed adulterated and the seller could face legal penalties including imprisonment and fines.

Quality assurance for the dairy industry

For dairy manufacturers and processors, these standards create a level playing field. Every producer must meet the same minimum compositional requirements, which prevents a race to the bottom where manufacturers might cut costs by reducing fat content or adding non-dairy substitutes. This is particularly important in India, where the dairy sector involves millions of small-scale producers and processors.

Public health protection

The prohibition on foreign ingredients in cream is directly tied to public health. Adulterated cream products – those containing vegetable oils, synthetic fats, or undeclared additives – can cause allergic reactions, digestive issues, and long-term health problems. The PFA Act’s strict compositional requirements were specifically designed to address these risks.

The transition from PFA to FSSAI

The PFA Act served India well for over 50 years, but by the early 2000s, it was clear that a more modern, comprehensive food safety framework was needed. India had multiple food laws operating simultaneously – including the PFA Act, the Fruit Products Order (1955), the Milk and Milk Products Order (1992), and several others – creating overlapping jurisdictions and enforcement gaps.

The Food Safety and Standards Act of 2006 consolidated all these laws under a single regulatory body, the FSSAI. The PFA Act was formally repealed when the FSSA came into full effect. However, many of the original PFA standards – including those for cream – were carried forward into the new FSSAI regulations with updates and refinements.

The FSSAI framework brought several improvements over the PFA system. It shifted the focus from merely preventing adulteration to a broader mandate of ensuring overall food safety. It introduced mandatory licensing for food business operators, established a science-based approach to standard-setting, and created more effective enforcement mechanisms. For cream and other dairy products, this meant more detailed compositional standards, stricter labelling requirements, and better monitoring of the supply chain.

Practical implications for dairy professionals and consumers

Understanding cream standards under the PFA Act – and their evolution into current FSSAI regulations – has practical value for anyone involved in the dairy sector. Dairy technology students and professionals need to know these standards because they directly impact product formulation, quality control testing, and regulatory compliance.

For dairy processors, knowing the fat content thresholds for each cream category is essential for standardising cream to the correct fat level after separation. The standardisation process involves adjusting the fat content of separated cream – either by adding skim milk to reduce fat or by further separation to increase fat – to meet the required standards for the intended product category.

For consumers, these standards provide a basis for making informed purchasing decisions. When you see a cream product labelled as “low fat” or “high fat,” those terms have specific legal meanings backed by defined compositional requirements. If a product does not meet those requirements, it is considered adulterated or misbranded under the law.
